Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of the Terms of Service at dependably.ca/terms (the "Terms"). It applies to the Site and to the Cloud Services, Dependably Cloud and the hosted plans for Dependably StatusCheck, as the Terms define them (together, the "Services"). Software of ours that you run on your own infrastructure is governed by its own licence, not by this AUP (Terms, Section 1).

1. Illegal content

Do not use the Services to store, distribute, publish, or send content that is illegal under Canadian law or the law that applies to you or your users. That includes:

• content that infringes copyright, trademark, patent, or trade secret rights
• content whose distribution violates export controls or sanctions
• child sexual abuse material, content that incites violence or hatred, and models or other artefacts built to produce either, or to produce intimate imagery of real people without their consent
• personal information collected or redistributed in violation of privacy law
• commercial electronic messages that do not meet Canada's Anti-Spam Legislation. Send status page subscribers the updates they subscribed to and nothing else.

2. Malware

Do not distribute malware, ransomware, spyware, or any other malicious code through the Services, including packages, images, models, or other artefacts that carry backdoors, time bombs, or other payloads intended to harm whoever consumes them.

3. Attacks on the Services or anyone else

Do not:

• attack any third party from the Services: denial of service, scanning, credential stuffing, phishing, and similar, whether through artefacts, status pages, or subscriber email
• attempt to gain unauthorized access to any account, system, or data, including other customers' data by any side channel
• circumvent authentication, rate limits, access controls, or plan limits
• deliberately degrade the Services for other customers, for example by flooding them with requests or uploading artefacts built to strain them
• harvest or bulk-extract data from the Services that is not yours, including other customers' artefacts, metadata, or status pages, to build a dataset, an index, or a competing service
• probe or test the security of the Services except as our Security Policy at dependably.ca/security authorizes. That policy defines the scope of permitted testing and our safe harbour for good-faith research.

4. Monitoring systems you are not authorized to monitor

Point monitors only at systems you are authorized to monitor: systems you own or operate, systems whose operator has given you permission, and public endpoints your own systems depend on, checked the way an ordinary client would. Checks run from our infrastructure on your behalf, and you are responsible for having the permission to run them. Do not use the Services to scan, probe, or watch any other system.

5. Forged provenance

Do not forge or alter signatures, attestations, checksums, or provenance metadata; do not present artefacts you did not produce as your own, or your own as someone else's; and do not misstate the origin or training data of a model you publish. Do not publish artefacts or status pages under names chosen to pass as another person or organization.

6. Your account

If you learn that your account or one of your users is violating this AUP, stop it and tell us at security@dependably.ca. If we forward an abuse report about your account or one of your users, respond within 1 business day.

7. How we enforce this AUP

Where practical we start with the narrowest measure that stops the problem and widen it only if the problem continues:

1. a warning that describes the problem and what needs to change
2. a limit on the rate or volume of the specific activity
3. restriction or removal of the specific artefact, monitor, status page, or user involved
4. suspension of the account
5. termination under Section 13.2 of the Terms

Where there is an imminent risk to the Services, other customers, or third parties, or where the law requires it, we may act first. Either way we tell you as soon as we reasonably can.

8. Reporting abuse

If an account, artefact, monitor, or status page on the Services violates this AUP, email:

• security@dependably.ca for malicious or illegal content and security-relevant abuse, including account compromise, phishing, and attacks
• legal@dependably.ca for intellectual property claims

We do not screen content in advance; we act on reports and on what we find, illegal content and active harm first. We read every report, we may ask for more information, and we may not reply to every one, except copyright notices, which we handle as Canada's Copyright Act requires. We forward intellectual property claims to the account holder and we act on court orders.

9. Changes and questions
